Elevate Jet, LLC ("Elevate Jet," "we," "us," or "our") operates the Elevate Jet mobile application and website (collectively, the "Platform") for charter jet booking and related services. Our principal business address is 1111 Lincoln Rd., Suite 500, Miami Beach, FL 33139.

1. WHAT PERSONAL DATA WE COLLECT AND WHY WE COLLECT IT
We collect personal data in accordance with applicable laws and only for legitimate business purposes. Some information is necessary to provide the services offered through Elevate Jet.
Information You Provide to Us
This includes:
- Contact Information, Account Information, and Profile Information including your first name, last name, phone number, postal address, email address, date of birth, and profile photo, some of which will depend on the features you use.
- Identity Verification and Payment Information including images of your government issued ID (as permitted by applicable laws), your ID number or other verification information, bank account or payment account information. If you are not an Elevate Jet user, we may receive payment information relating to you, such as when an Elevate Jet user provides your payment card to complete a booking on your behalf.
You may also choose to provide us with additional personal information, which may include:
- Additional Profile Information such as aircraft or travel preferences.
- Other Information, such as when you fill in a form, add information to your account, post comments, or communicate with our operations team.
Information We Collect Automatically
When you use the Elevate Jet Platform and Payment Services, we automatically collect personal information. This information may include:
- Usage Information. Such as the pages or content you view, searches for empty legs, bookings you have made, and other actions on the Elevate Jet Platform.
- Log Data and Device Information. Such as details about how you've used the Elevate Jet Platform (including if you clicked on links to third party applications), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, cookie data, and the pages you've viewed or engaged with before or after using the Elevate Jet Platform. We may collect this information even if you haven't created an Elevate Jet account or logged in.
- Payment Transaction Information. Such as payment instrument used, date and time, payment amount, payment instrument expiration date and billing postcode, IBAN information, your address, and other related transaction details.
Mobile Application Technical Information
When you download and use any of our mobile apps, we collect certain technical information from your device to enable the app to work properly and as otherwise described in this Privacy Policy. That technical information includes:
- Device and telephone connectivity information such as your carrier, network type, network operator, subscriber identity module ("SIM") operator, and SIM country
- Operating system and version
- Device model
- Performance and data usage
- Usage data, such as dates and times the app accesses our servers, the features and links clicked in the app, searches, transactions, and the data and files downloaded to the app
- Mobile device settings
- Other technical information such as app name, type, and version as needed to provide you with services
Sensitive Personal Information
In compliance with the California Privacy Rights Act ("CPRA") and other U.S. state laws, we disclose that we may collect "sensitive personal information", such as:
- Government IDs (collected for identity verification purposes as described above)
- Precise geolocation (if you opt in through your device settings)
- Health information (only if provided voluntarily by you for special accommodation requests)
We do not use sensitive data for any purposes beyond what is necessary to provide requested services, prevent fraud, or comply with law.

- Facilitate platform access, process bookings and payments.

3. EMAIL AND PUSH NOTIFICATION PREFERENCES
When you create an Elevate Jet account, certain notifications are automatically enabled to provide essential service:
Automatically Enabled (Transactional Communications)
- Flight Updates: Booking confirmations, pre-flight instructions, flight reminders, post-flight receipts, and reminders to complete bookings you've started
- Operational Notifications: Weather delays, aircraft changes, safety alerts, and other time-sensitive service updates
These transactional communications are necessary to provide our services and cannot be disabled. However, you may adjust delivery preferences (email, push, SMS) in your account settings.
Optional Marketing Communications (Opt-In Required)
- Hot Deal Opportunities: Price drops, seasonal promotions, and limited-time offers
- Club 45: Weekly destination guides, travel inspiration, member events, and industry insights
You control whether you receive marketing communications and can update your preferences anytime in Settings.
Sales and Service Communications
When you demonstrate interest in our services (such as browsing flights, requesting quotes, or starting a booking), our team may contact you to assist with your travel needs. You may opt out of sales communications at any time by replying to any sales email or contacting us directly (see Section 13, "Contact Information").
4. SHARING & DISCLOSURE
We share your personal information as described below and in this Privacy Policy, and as permitted by law:
- Within Elevate Jet and its affiliated companies.
- With courts, law enforcement, or government authorities where required by applicable law.
- With third-party service providers for credit card processing, customer service, analytics, fraud prevention, marketing, and tailored advertising (subject to confidentiality obligations). These service providers include:
5. INTERNATIONAL DATA TRANSFERS
We may transfer your information to jurisdictions outside your country of residence, including to the United States and other countries necessary for service. Where required by applicable law, we implement Standard Contractual Clauses (SCCs), adequacy decisions, or other appropriate safeguards to ensure equivalent data protection as required under applicable data protection laws, including the EU General Data Protection Regulation (GDPR) and UK GDPR.

6. YOUR RIGHTS
Depending on where you live, you may have rights to:

- Deletion: Request deletion of your personal data (subject to legal exceptions, such as compliance with legal obligations or completion of transactions you have requested).

- Limit Use: Limit how sensitive data is used and disclosed.
- Object to Processing: Object to marketing or profiling activities, or to processing based on legitimate interests.
- Withdraw Consent: Where processing is based on consent, withdraw at any time (without affecting the lawfulness of processing prior to withdrawal).
- Appeal Denials: Appeal any denied privacy request (under CPRA and other U.S. state laws).
- Lodge a Complaint: If you are located in the European Economic Area, United Kingdom, or Switzerland, you have the right to lodge a complaint with your local data protection authority.
Non-Discrimination: We will not discriminate against you for exercising any of these rights. You will not be denied service, charged different prices, or provided a different level of service solely for exercising your privacy rights.

We use cookies and similar tracking technologies (collectively, "Cookies") to operate the Platform, analyze user activity, and personalize content. Cookies are small text files stored on your device that help us recognize you and remember your preferences.

We retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. We implement and regularly update administrative, technical, and physical safeguards to protect your information, including encryption of data in transit and at rest, access controls, and regular security assessments. However, no organization can guarantee absolute security, and no method of transmission over the internet or electronic storage is 100% secure. If you have reason to believe that your interaction with us is no longer secure, please contact us immediately using the information in Section 13.
10. SMS/TEXT MESSAGING COMMUNICATIONS
SMS Consent and Opt-In
We may collect your mobile phone number to send you text messages related to our services. SMS messages may include booking confirmations, flight updates, promotional offers, and other service-related communications. Message and data rates may apply depending on your mobile carrier plan.
By providing your mobile phone number and opting in to receive SMS messages, you expressly consent to receive text messages from Elevate Jet. Consent is not required as a condition of purchase. You may opt-out at any time by texting STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to SMS Messages received by your device.
SMS Data Processing
SMS communications are processed through our third-party service. Your mobile phone number and SMS interaction data may be shared with Elevate Jet’s SMS provider for message delivery and analytics. SMS data is subject to the same security and retention policies as other personal information described in this Privacy Policy.
Legal Basis for SMS
- Marketing SMS messages are sent based on your explicit consent.
- Administrative SMS messages are sent based on our legitimate business interests for service delivery and to fulfill our contract with you.
- You have the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before withdrawal or your access to other services.
Third-Party Sharing
Mobile information will not be shared with third parties/affiliates for their own marketing/promotional purposes. SMS originator opt-in data and consent information will not be shared with any third parties except as necessary to provide the SMS services described in this Privacy Policy.
11. CHILDREN'S PRIVACY
The Elevate Jet Platform is not intended for use by children under the age of 13 (or 16 in the European Economic Area). We do not knowingly collect personal information from children under these ages. If you are a parent or guardian and believe your child has provided us with personal information, please contact us using the information in Section 13, and we will take steps to delete such information from our systems.
12. CHANGES TO THIS PRIVACY POLICY
We may modify this Privacy Policy from time to time to reflect regulatory updates or changes in our practices. If changes are material, we will notify you at least 30 days in advance by email (to the address associated with your account) or within the Platform. The updated Privacy Policy will include a new "Effective Date" at the top of the document. Continued use of the Elevate Jet Platform or any Elevate Jet services after the effective date implies your consent to the updated policy. If you do not agree to the changes, you should discontinue use of the Platform and contact us to close your account.
